Your board says the building is compliant. That is an answer about this year.

Local Law 97 charges New York buildings a penalty for every metric ton of emissions above their cap - every year they stay over. It is not a one-off fine. It recurs, and it grows.

Here is the part most boards have not modelled.

The first compliance period was set at levels that caught mainly the worst performers, so most buildings came in under and concluded they had no problem. The limits beginning in 2030 are dramatically tighter, and reporting suggests they will affect roughly three quarters of covered buildings - including many sitting comfortably under their cap today.

Only around a fifth of affected buildings are expected to meet the 2030 caps without significant work starting now. And that work - electrification, envelope, plant replacement - takes years to plan, fund and install. A board that waits until 2029 can end up paying penalties under two compliance periods at once.

For a co-op or condo the corporation or association is the responsible party, so the penalty is a building operating expense. It reaches you through maintenance or common charges. You did not choose the boiler. You will still pay for it.
