The cultural phenomenon, differentiating itself from nature[1], it is built with iteration of ways of acting and the constant relationship between people in their habitat and, therefore, this performance is made from a collective will aimed at elevating the role of the environment as a driving element capable of go beyond the present moment to meet the subsequent moment, which will constitute a new social reality, fostering the meeting of different interests, with a common purpose of meeting their well-being[2]. In this way, it is important to consider in the constitution of the legal system its ethical and social composition, as a determining factor in the control of State power, in addition to emphasizing in a special way, the perspective of State action in directing its public policy. Therefore, the objective of this study is to bring a meager scientific contribution through which it can translate into the necessary presence of the axiological subsystem in the formulation of Law and its effective service, depending on the interest of social conscience in pursuing in the foreground its own systemic development and then or concomitantly with the development of other systems enshrined in the universe – economic, family, etc. –, arising from the full and constant communication between everyone.
