This book is written as a constructive critique. It respects courts, tribunals and constitutional tradition, but it also asks difficult questions. A mature justice system is not weakened by criticism. It is strengthened when its bottlenecks are identified honestly and corrected with courage.
The discussion is deliberately direct. It avoids unnecessary jargon and uses examples, tables and checklists. The object is not to attack individuals. The object is to study institutional pressures that can make judgment less fearless than the Constitution expects.
